a. b. The online store, active on the website https://mysnep.com, is the only store authorized to sell SNEP branded products.
2. Sales contract parties
a. These terms and conditions govern any contract related to the sale of the products offered on the website https://mysnep.com, stipulated between SNEP and the following individuals (hereinafter referred jointly as “Customers” and individually as “Customer"): - the final consumer or user: a natural person acting for purposes other than entrepreneurial, commercial, artisan or professional activity; - professional: natural or legal person acting for the purposes of their entrepreneurial, commercial, artisan or professional activities, or their intermediaries, including those persons acting as SNEP independent distributors, based on the distribution contract stipulated with SNEP.
b. The online purchase of products and services from the website https://mysnep.com implies full acceptance, without reservation, of these general sales terms and conditions (hereinafter referred to as “General Conditions”) and of all the provisions set forth in the different sections of https://mysnep.com, including those accessible through links, such as the Privacy Policy. The General Conditions will remain valid until their modification and/or integration by SNEP, also following new regulatory requirements. In case of changes and/or integrations, the General Conditions shall enter into force from the date of publication on the website https://mysnep.com, and will be applied to the orders made from that date onwards. The latest updated version of the General Conditions can be found in the specific section of the website https://mysnep.com
3. Subject matter of the sales contracts
a. The subject matter of the sales contracts are all the products present on the website https://mysnep.com which, at the time of the Customer’s order, are displayed on the website https://mysnep.com
b. SNEP will implement any measure to update all the offers present on the website https://mysnep.com. If a product is not available at a certain time, SNEP will supply all the necessary information next to the product image to stop the purchasing orders for that product.
c. The product availability on the website https://mysnep.com depends on the type of product and on the quantity ordered.
d. All product prices are expressed in Euro and include VAT. The Customer must make the purchase in Euro. SNEP does not accept any other currencies nor payments in instalments. The prices published are those available at the time of the order registration.
e. SNEP reserves the right to edit the price of the products displayed on the website https://mysnep.com at any time without further notice. Any change made to the prices will not apply to the products for which the orders have already been accepted by SNEP. In case of price reductions, no difference will be recognized on the amounts already paid. The product shipping rates are displayed on the website https://mysnep.com.
f. SNEP reserves the right to remove one or more products from the website https://mysnep.com without notice
4. Orders
a. Product orders on the website https://mysnep.com can only be made by filling out and digitally submitting - according to the related instructions - the order form published on the website https://mysnep.com, 24/7. Any purchase orders submitted in a different way than the one shown here, by way of example, via email or fax, shall not be valid, except for the orders via phone that a registered customer can execute in exceptional cases. The order form refers to these General Conditions and summarises the essential characteristics of each product ordered, the related price (including all applicable taxes), the payment methods that the Customer can use to purchase each product and the delivery method for the purchase products, the shipping and delivery date, a reference to the conditions to exercise the right of withdrawal and the deadline and methods to return the purchase products. By transmitting the order form, the Customer will acknowledge and accept these General Conditions and the additional information contained on the website https://mysnep.com, including those accessible through links.
b. The order acceptance is confirmed via email. If SNEP cannot confirm an order within 7 (seven) days due to an issue attributable to the Customer (by way of example, failure to receive payment, wrong personal data, no contact with the Customer), the Customer will immediately receive a phone or email notification concerning this issue and, if no acknowledgement is given by the Customer, the order will be cancelled.
c. Validation of the order by the Customer implies a total acceptance of these General Conditions, without reservations. To validate the order, the Customer must click on the button “Submit Order”. SNEP will send an email to the Customer to notify the order at the email address entered by the Customer. Then, SNEP will send a summary email to confirm the order. The Customer will receive a shipping code and will be able to check the status of the shipment at any time on the website of the carrier: GLS or another carrier chosen by the company. After receiving this notification via email, the sales contract is stipulated and SNEP reserves the right to cancel an order at any time, especially if the product ordered is not available at the supplier, or for other commercial, logistic or legal reasons which will be notified to the Customer. This provision will be applied also if, due to an error or technical issue, the product price or description are significantly different. If the product is not available at the moment, SNEP will contact the Customer to edit or cancel the order.
5. Payments
To pay the product price and the related shipping and delivery fees, the Customer can use one of the following methods, also indicated on SNEP’s order form, on the website https://mysnep.com
a. Credit card: Those customers who wish to pay with a credit card must make sure that it is enabled for online purchases, and must enter all data correctly on the order form. SNEP accepts MASTERCARD, VISA, VISA ELECTRON AND PAYPAL. Using a credit card to make online purchase is a fast and safe method. SNEP undertakes to preserve the confidentiality of the Customer’s credit card and personal data.
b. Wire transfer: Using this method of payment, the purchase order will be completed as soon as SNEP receives the payment on its bank account. To this end, the Customer must execute the wire transfer to SNEP using the bank coordinates and all the other necessary info that will be supplied by SNEP at the time of the order confirmation via email.
c. Cash on delivery: Retail customers, only if previously authorized by their distributors, can make an order paying with cash on delivery. This payment system includes a 5 Euro fee (including VAT) which will be calculated when the payment method is chosen. The purchase order will be completed when SNEP will receive the payment from the carrier.
d. SNEP covers all shipping costs with any payment method for all orders exceeding 300 Euro including VAT; for all the orders under 300 Euro including VAT, a 6 Euro including VAT shipping fee will be included at the time of the order on the website https://mysnep.com The delivery time is indicated in working days (from Monday to Friday) and depends on the delivery area.
c. Delivery will be proven in writing. When signing the written reception confirmation, the Customer becomes the owner of the purchased products, thus, from that time on, he/she will be the only one responsible for any risk related to its possession and use; in particular, the Customer will be responsible for the risk of loss and damages to the purchased products.
d. Upon receiving the product, the Customer must check that the package has not been damages during transport. Upon receiving the delivery, in case of manifest damages to the package, the recipient may reject the delivery or, as an alternative, accept it with reserve, by applying a specific note on the delivery slip before signing the acceptance, specifying the reasons and promptly notifying the extent of the damage, if possible. In any case, pursuant to the law, the recipient has 8 (eight) days to check the integrity of the content and submit a written complaint to the local carrier branch, while promptly notifying also SNEP, which will instruct the Customer on how to manage any damage suffered. For any complaint concerning the integrity of the package, you should also contact SNEP Italia to notify the accident. After the Customer accepts the package, any time of claim related to the loss or damage of the product during shipping will no longer be accepted. The failure to complain at the time of delivery by the Customer will exclude any further complaint by the Customer.
e. SNEP reserves the right to change the prices displayed on the website https://mysnep.com without notice. Any change to the prices will not involve the orders already processed, according to these General Conditions.
f. The products will be delivered to the address stated by the Customer in the order form, provided that the data have been included in a complete and accurate way. SNEP shall not be responsible for any delay or failure to deliver the purchased products attributable to the carrier and/or to force majeure events, such as, by way of example, natural events, strikes, traffic and peak periods.
8. Complaints
a. All products sold on SNEP website are new and free from physical and legal defects.
b. SNEP is responsible for its products pursuant to the applicable laws.
c. All complaints related to the packages delivered by the carrier will be assessed only based on a report on the damages signed by the Customer and by the employee of the carrier in charge of the delivery. Any complaint concerning discrepancies of the delivered products with the ordered ones must be submitted via registered mail within 14 (fourteen) days from the date of the delivery.
d. The only way to submit a complaint is via registered letter to SNEP SpA Viale Italia no. 1 56038 - Ponsacco (Pisa) .
e. The provisions pursuant to letters f) and g) of paragraph 6 ("Delivery") apply also to complaints on products.
f. SNEP shall not be liable for damages to the exterior of the products.
9. Reimbursement Guarantee for New Customers
a. SNEP offers to its new Customers a 100% reimbursement guarantee within 30 (thirty) days, except for the shipping fees, which amount to 6 Euro including VAT, for any package of SNEP product bought for the first time on the website https://mysnep.com
b. SNEP will reimburse the price of the produce after receiving a written request by the Customer via registered letter asking to benefit from the reimbursement guarantee. Along with the written request, the Customer must also submit the packages - even the empty ones - to the following address: SNEP SpA Srl - Viale Italia n. 1 56038 - Ponsacco (Pisa) .
c. The Customer will bear the shipping costs for the empty packages pursuant to the previous paragraph.
10. Right of Withdrawal and Return
a. Sales of products on the Internet to consumers or final users are governed by articles 47, 48 and 64 of Legislative Decree no. 206 of 6 September 2005 (Consumer Code). The regulation involves the right of the consumer to withdraw from contracts without any penalty and without having to specify any reason, guaranteeing them the right to return the purchased product and obtain the reimbursement of the entire amount paid, including any shipping fees (except for additional costs resulting from the Consumer’s choice to use a different type of delivery than the standard one offered), within 14 (fourteen) days from the reception of the product. The Customer can exercise the right of withdrawal by submitting a written notification (see the form attached HERE) to be submitted via registered letter or telegram, telex and email to info@mysnep.com or telefax to +39 0587/735766 , provided that it is confirmed by a registered letter sent within forty-eight hours to:

c. Pursuant to article 55, paragraph, 2, of the Consumer Code, the Customer cannot exercise the right of withdrawal in the following cases: supply of custom or custom-packages products or products that, due to their nature, cannot be reshipped because they would rapidly wear down.
d. Furthermore, the right of withdrawal cannot be exercised by the Customer if the product is not in perfect conditions, that is: - Without the original package; - without the essential product elements; - damage to the product caused by the Customer.
e. To return the products when exercising the right of withdrawal, the Customer has fourteen (14) days from the delivery of the product. Products to be returned must be shipped to the address indicated in previous paragraph 9, letter b), along with a valid purchase and payment receipt and with the return form indicated above to state the will to resort to the right of withdrawal. All reimbursement will be made free of charge within 14 (fourteen) days without delay, and, in any case, within 14 days from the notification of the will to resort to the right of withdrawal. Reimbursements can be suspended until the goods are returned or until you prove that you have actually shipped them. You must ship or deliver the goods to SNEP without delay within 14 days from the notification of your intention to resort to the right of withdrawal. This term shall be deemed observed if you ship the goods within the 14 day period. You shall bear all return costs. You are responsible only for the reduction in the product value resulting from handling of the same for purposes other than establishing its nature, characteristics and functioning.
f. All products must be returned in their original package, in perfect sales conditions (not worn, damaged, soiled or copied in any way by the Customer). The integrity of the goods to be returned is essential to exercise the right of withdrawal; in any case, it is sufficient that the returned good is in standard conditions and preserved with due diligence.
g. The only costs and risks related to the right of withdrawal are those involved in returning the Goods to SNEP, which shall be borne by the Customer.
h. Reimbursements include the product purchase prise and the shipping fees, except for the fees sustained to return the product, which shall be borne by the Customer. The reimbursement will be made through the same payment method used by the Customer.
11 Final provisions
a. The contents of the website https://mysnep.com (products and prices) does not constitute an offer, but a simple call to conclude a purchase contract.
b. By accepting the General Conditions, the Customers agrees to the data processing, except for those strictly necessary for operations and services required by the Customer, since no consent is required for those activities.
c. SNEP shall not be responsible for any delays or defaults in exercising its contractual obligations due to circumstances beyond its control, such as force majeure events, wars and other conflicts, uprisings, coups, civil wars, strikes or lock-outs, earthquakes or other natural disasters, fires, death, termination of the activity by the suppliers, decisions of the legal authorities, regulatory and/or penalty measures and/or in any case whenever it is professionally impracticable to exercise its activities.
d. The names of the products displayed on the website https://mysnep.com are used only for identification purposes and may be third-party trademarks.
e. SNEP will adopt any reasonable means to ensure that the contents of the website https://mysnep.com reflects the market reality and, through these General Conditions, SNEP notifies its Customers on the possibility of errors that may occur while updating technical parameters of the website https://mysnep.com. Updating the data after errors or delays cannot constitute a basis for any claim by the Customers against SNEP
g. The entire content of the website https://mysnep.com is protected by copyright. All the data displayed on the website https://mysnep.com, all the trademarks shown on the website https://mysnep.com, all the software and/or technologies used on the website https://mysnep.com and, in general, all or part of the websites are reserved and protected. It is strictly forbidden to reproduce trademarks and logos used on the website https://mysnep.com: the Customer undertakes not to copy, edit, translate, reproduce, diffuse, sell, publish, improve and spread in any other way in a different format the data, in whole or in part, present on the website https://mysnep.com.
h. SNEP reserves the right to edit these General Conditions. Before submitting an order to SNEP, please read carefully these General Conditions and all the related, referred or linked documents.
i. These General Conditions are governed by the Italian law, and, in particular, by Legislative Decree no. 206 of 6 September 2005, the Consumer Code, with specific reference to the provisions on remote contracts. This contract is drafted in Italian. Should any dispute arise between SNEP and its Customers concerning these General Conditions, SNEP guarantees the full acceptance of the RisolviOnline arbitration service.
